UPLIFTEXP.COM™ The UPLIFTEXP website (the “Website”) provides information about UPLIFTEXP, its members, managers, officers, directors, employees, agents, instructors, and contractors including, without limitation, Dorian Besancon, (together, “UPLIFTEXP”). The Website also provides information regarding the affiliates of UPLIFTEXP and related companies (“Affiliates”) and parties unrelated to UPLIFTEXP (“Third Parties”). In addition, the following Terms of Use apply to your participation in the UPLIFTEXP.com Workshop & Session (the “Program”). The term “UPLIFTEXP” shall include reference to the Program. The Website is made available to the public subject to the following terms, policies, and guidelines. When referring to the “Website” in these Terms of Use, such reference includes information provided on the Website and information provided through any mobile device, DVD, videotape or other similar medium accessed or downloaded via the Website.
By visiting or using the Website, you agree to abide by these Terms of Use. If you do not wish to be bound by these Terms of Use, you may not use the Website and must immediately cease use of the Website. Please read these Terms of Use carefully. UPLIFTEXP; UPLIFTEXP.com;UPLIFTEXP Gather; UPLIFTEXP Fire & Ice; UPLIFT Breath & Ice; UPLIFTEXP Breath for life Course, UPLIFTEXP Retreats & UPLIFTEXP Coaching. UPLIFTEXP addresses only non-urgent subjects of a general nature. UPLIFTEXP does not take into account the medical conditions of individual users, and none of the information provided in UPLIFTEXP should be considered a substitute for personal medical attention, diagnosis or treatment. Subscription Service; Billing and Renewal. UPLIFTEXP is a subscription based program. When you choose to sign up for UPLIFTEXP, you agree to the terms of our subscription services. Your subscription term is based on the initial level of subscription you select. At the time that your initial membership package expires, your subscription automatically will revert to a monthly membership. Your credit card will be charged, on a monthly basis, as long as you continue to subscribe to UPLIFTEXP. UPLIFTEXP will not provide you with any notice of renewal or confirmation that your credit card is being or has been charged. In order to sign up for UPLIFTEXP, you will be required to provide certain information including, without limitation, your name, address, telephone number and credit card information.

We are a small own business and we try our best to create a positive customer experience.
We maintain the information you provide to us as confidential pursuant to the terms of our Privacy Policy which may be accessed on this Website. The information you provide will form the basis of your account with us. You agree to provide this information as well as any other mandatory information and agree that such information provided will be accurate and current. You represent and warrant that you are an authorized user of the credit card provided to us and you agree to pay all charges resulting from your subscription services at the prices then in effect. You agree to be responsible for any and all charges to your account, including applicable sales tax, and all associated renewal fees until notice of cancellation is received by UPLIFTEXP. You agree that all such charges may be charged to the credit card provided with your account and that the Terms of Use in effect at the time your account is charged shall govern. You agree that your account may be terminated by us at any time for any or no reason. You may cancel your membership at any time within the ten (10) day period following the calendar date on which you subscribe to UPLIFTEXP and will receive a full refund. In the event that you cancel your subscription at any time after the ten (10) day period following the calendar date on which you subscribe to UPLIFTEXP, you will not be entitled to receive any refund. At the end of the initial term of your subscription, ten (10) day period, your subscription will automatically revert to a monthly membership and your account will be charged on a monthly basis until you cancel your membership. Your subscription to UPLIFTEXP is based on the subscription level you select at the time you register for UPLIFTEXP. Following are descriptions of each subscription level.
GATHER MONTHLY CLASSES and Private Coaching Sessions Cancelation / Refunds. Participants who sign up and pay are eligible for a full refund within 7 days of initial payment, as long as there are 24 hours or more until the first Monthly Classes/coaching session begins. A refund will not be issued after 7 days of the marked payment date, or if there are 23 hours or less until the start of the Monthly Classes/coaching session. Full Payment is due 24 hours prior to the Monthly Classes/coaching session. If the customer misses the 7-day refund window, the customer has the opportunity to transfer their payment to a future UPLIFTEXP Monthly Classes/coaching session occurring within 1 year, and will not be assessed a transfer fee. The customer is only eligible to transfer deposit to another Monthly Classes/coaching session one (1) time. In all circumstances, transfer of deposit to another offered UPLIFTEXP Monthly Classes/coaching session must be requested a minimum of 24 hours before the Monthly Classes/coaching session start date. No refunds or transfer can be accommodated if there are 24 hours or less to the start of Monthly Classes/coaching session.
BREATH FOR LIFE Course and FIRE & ICE or BREATH & ICE Session Cancelation / Refunds. Participants who make a deposit (total or half) are eligible for a full refund within 7 days of initial payment, as long as there are 48 hours or more until the BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session begins. A refund will not be issued after 7 days of the marked payment date, or if there are 47 hours or less until the start of the BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session. Full Payment is due 48hours prior to the BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session. If the customer misses the 7-day refund window, the customer has the opportunity to transfer their deposit (total of half) to a future UPLIFTEXP BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session occurring within 1 year, and will not be assessed a transfer fee. The customer is only eligible to transfer deposit to another BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session one (1) time. In all circumstances, transfer of deposit to another offered UPLIFTEXP BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session must be requested a minimum of 48 hours before the BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session start date. No refunds or transfer can be accommodated if there are 48 hours or less to the start of BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session.
Workshop & Session Refunds. Participants who make a deposit (total or half) are eligible for a full refund within 7 days of initial payment, as long as there are 48 hours or more until the course or Session begins. A refund will not be issued after 7 days of the marked payment date, or if there are 47 hours or less until the start of the course & Session. Full Payment is due 48hours prior to the course & Session. If the customer misses the 7-day refund window, the customer has the opportunity to transfer their deposit (total of half) to a future UPLIFTEXP Breath for life course & Session occurring within 1 year, and will not be assessed a transfer fee. The customer is only eligible to transfer deposit to another course & Session one (1) time. In all circumstances, transfer of deposit to another offered UPLIFTEXP Breath for life course & Session must be requested a minimum of 48 hours before the course & Session start date. No refunds or transfer can be accommodated if there are 48 hours or less to the start of course & Session.
Please note, UPLIFTEXP has the right to cancel a Gather class, Breath for life course/session, Fire and Ice session, Breath and Ice session or Coaching session and Retreat due to weather, unavailability (sudden illness), not enough attendees etc. In these cases you will be notified and refunded in full.
Retreat Refunds. Participants who make a deposit (total or half) are eligible for a full refund within 7 days of initial payment, as long as there are 30 days or more until the Retreat begins. A refund will not be issued after 7 days of the marked payment date, or if there are 29 days or less until the start of the Retreat. Full Payment is due 30 days prior to the Retreat. If the customer misses the 7-day refund window, the customer has the opportunity to transfer their deposit (total of half) to a future UPLIFTEXP Retreat occurring within 1 year, but will be assessed a $750 transfer fee. The customer is only eligible to transfer deposit to another Retreat one (1) time. In all circumstances, transfer of deposit to another offered UPLIFTEXP Retreat must be requested a minimum of 30 days before the Retreat start date. No refunds or transfer can be accommodated if there are 30 days or less to the start of Retreat.
Please note, UPLIFTEXP has the right to cancel a Monthly Classes, Coaching session, Breath for life Course or Fire & Ice session, Breath & Ice session due to weather, unavailability (sudden illness), not enough attendees etc. In these cases you will be notified and refunded in full.

If you purchase a hotel room to attend the Monthly Classes, Coaching session, Breath for life Course or Fire & Ice session, Breath & Ice session (coming from out of town), we suggest you book a room that allows you to cancel without penalty. It is not the responsibility of UPLIFTEXP to pay for this additional purchase. If you need to cancel your registration for the certification, please contact UPLIFTEXP.

Usage Regulations. You may display, reformat and print information from the Website for your own personal, non-commercial use only. Distance Learning Streaming Video Release :
- I, the participant/guardian of the named participant, allow the participation in live instruction that is streamed into other households/homes. I understand that this content may be stored on a password-protected site for students to view after the learning activity has ended.
I understand that I can turn off the video camera if I do not want my image to appear, and it is my responsibility to communicate that decision to my teacher/coach.
This permission will remain in effect throughout my enrollment in UPLIFTEXP programs. Permission is required for participation in UPLIFTEXP programs during the COVID-19 pandemic.
Please note, UPLIFTEXP has the right to cancel a Monthly Classes, Coaching session, BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session due to weather, unavailability (sudden illness), not enough attendees etc. In these cases you will be notified and refunded in full.

If you purchase a hotel room to attend the Monthly Classes, Coaching session, BREATH FOR LIFE Course or FIRE & ICE or BREATH & ICE Session (coming from out of town), we suggest you book a room that allows you to cancel without penalty. It is not the responsibility of UPLIFTEXP to pay for this additional purchase. If you need to cancel your registration for the certification, please contact UPLIFTEXP.
Waiver of Liability Related to Coronavirus/COVID-19 :
- Thank you for entrusting us during this challenging time.
Like other programs in our area, we are requiring that participants and others who come to our programs sign a waiver for COVID-19. This is an important part of our ability to remain open and continue to serve you and your community.
Some background that we all know:
The novel coronavirus, which causes COVID-19, has been declared a worldwide pandemic by the World Health Organization.
COVID-19 is reported to be extremely contagious.
The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air.
People reportedly can be infected and show no symptoms and therefore spread the disease.
The exact methods of spread and contraction are not well understood, and there is no known cure or vaccine for COVID-19.
COVID-19 can cause serious and potentially life threatening illness and even death.
The UPLITEXP organization is committed to the safety of the participants under our care, and of our teachers and staff. However, we cannot prevent you or anyone else from becoming exposed to, contracting, or spreading COVID-19 while utilizing our services or premises.
Whatever we do, it is not possible to completely prevent against the presence of the disease. Therefore, if you choose to utilize the UPLITEXP's services and/or enter onto the UPLITEXP's premises, you and any person authorized to bring you to or pick you up from our campus may be exposing yourselves to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and for my direct contacts in order to utilize the UPLIFTEXP's services and to enter theUPLIFTEXP's premises. These services are of such value to me and those I care for that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize the UPLITEXP's services and premises in person.
WAIVER OF LAWSUIT/LIABILITY: To the extend permitted under applicable law, I hereby forever release and waive my right to bring suit against UPLITEXP and its officers, directors, administration, teachers, staff, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing UPLITEXP's services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease, or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
CHOICE OF LAW: I understand and agree that the law of the State of California will apply to this waiver.

1. Think before you act
As with all physical activities, application of the UPLIFTEXP program and any related practices entails some degree of physical and mental risk. Be cognizant of your own capabilities and limits, both physical and mental, and act accordingly. If you have any concerns or questions regarding particular exercises, always feel free to reach out to us or the UPLIFTEXP-community.
Adhere to the following precept at all times: NEVER CONDUCT UPLIFTEXP-RELATED ACTIVITIES IN PLACES WHERE LOSING CONSCIOUSNESS IS EXTREMELY DANGEROUS (e.g. in water, whilst driving, etc.).
2. Take responsibility for your own actions
When you act on knowledge or insight, perceived or otherwise, pertaining to the UPLIFTEXP, and related matters discussed on our online spaces (e.g. websites, social media, YouTube), podcasts, books, manuals, or other content outlets, or those of related third parties, you do so voluntarily, and assume full responsibility. Accordingly, you agree to not hold UPLIFTEXP or its representatives, agents, suppliers, etc. responsible for any injuries or damages (you may incur) as a result.
3. Take it easy - it is not a competition
The UPLIFTEXP and associated exercises and techniques are not meant/intended to be performed in a competitive context. Go at your own pace and do not let your ego get in the way. Challenge yourself and show commitment, but don’t exceed personal limits in order to prove something to yourself or others. For most people, practicing the Method in a calm and consistent manner yields amazing results.
4. We are not doctors, medics or a medical institution
Nothing about the UPLIFTEXP method should be taken as medical advice. We may offer suggestions regarding physical and mental health —in the form of suggested exercises, nutrition, daily patterns, etc.— but such information is merely intended for educational and informational purposes, and we do not profess legitimate medical expertise. Furthermore, no recommendations or suggestions (whether specific or generic) should be regarded as medical diagnosis or treatment.
